Flood Disclosure Approved by Texas Real Estate Commission

On May 24, 2021, the Texas Legislature passed HB 531 providing that on January 1, 2022, landlords must begin to provide notice to tenant prospects if their property lies within a 100-year floodplain or whether or not the landlord is aware that the property has flooded within the last 5 years.

In response, Texas REALTORS® created the Addendum Regarding Rental Flood Disclosure to satisfy the requirement. The addendum is required to be provided to the tenant before the execution of the lease. In January, 2022, Hendricks Property Management amended its procedures to make sure all of our clients are in compliance.

On August 10, 2022, the Texas Real Estate Commission adopted a new form, Landlord’s Flooplain and Flood Notice, and added a new paragraph to the Seller’s Temporary Residential Lease and the Buyer’s Temporary Residential Lease.

The new forms only apply to temporary leases used in sales transactions and are not a requirement for long term leases.

Lacy Hendricks, RMP®

Lacy Hendricks, RMP®, joined Hendricks Property Management in 2014 to start her career in real estate and property management.  She became a licensed real estate agent in October 2014 and a licensed broker in 2023. Lacy serves and the Governmental Affairs chair for the National Association of Residential Property Management, and is the President Elect of the San Antonio. She has worked on governmental affairs committees for the San Antonio Board of REALTORS and the City of San Antonio since 2016 ands holds a handful of designations through the REALTOR organization. In 2023, she won Volunteer of the Year Award for NARPM, and in 2017 won the Legislative Champion Award from the San Antonio Board of REALTORS.
